What Happens When a Power of Attorney Expires in Dubai?

What Is the Power of Attorney in Dubai?

- Special POA – empowers the attorney to take specific actions like selling property on behalf of the principal or taking the principal’s place in a court of law.
- Durable POA – A durable POA remains valid despite the principal’s incapacity and usually used for financial or contractual obligations (e.g., mortgages)
POAs within Dubai are time-limited (common practice is 1–2 years) but duration is set by the document. Some POA are task-specific i.e. valid until task completion. The POAs are to be renewed or revoked before expiry for them to remain enforceable.
When does the Power of Attorney expire?
A Power of Attorney can come to an end in UAE law under the following circumstances:
- Completion of the task assigned; for example, if a POA issued to sell a property becomes invalid once the sale is completed.
- Expiration of the validity period; if a POA is time-bound (let’s say two years), it automatically expires unless renewed.
- By the death or legal incapacity of the principal-the POA extinguishes except in respect of a durable POA dealing with financial obligations.
- Death or incapacity on the part of the agent—the principal must appoint another approved agent.
- By revocation of principal-the principal has a right to cancel, at any time, a POA through an official revocation process.
These rules are contained in Articles 924-929 of the UAE Civil Transactions Law and enforced by Dubai Courts and Notary Public.
What Happens After POA Expires?
Once a Power of Attorney has expired, the agent becomes incapable of acting on the part of the principal, and this invalid action may carry the consequence of legal action.
Generally:
- Loss of authority -the agent is not permitted to represent the principal for any matter.
- Invalid transactions- All steps and actions after expiry shall render null and void any or all contracts, payments, or decisions taken.
- The return of documents and assets-the agent shall return to the principal all documents, funds, or property received under the POA.
- Notifying the third parties- Banks, courts, and other government agencies and entities need to be informed on expiration.
- Legal Liability– Any actions performed by the agent after the expiration may make him accountable for damages or fraud.
How to Handle an Expired Power of Attorney

- Notify the agent and all third parties who in the past dealt with the POA.
- If the POA was used in litigation, officially request cancellation from the Dubai Courts.
